After the Hugging Face hack, LASTT staff members set aside their normal workload “to design, coordinate, and participate in a briefing regarding this incident for regulators,” and have since responded to more requests for information that required additional work. LASTT staff spent dozens of man hours responding to OpenAI’s unsafe development practices, according to the lawsuit.
“Despite the impact on LASTT’s other programs, LASTT nevertheless devoted its resources to attempting to thwart OpenAI’s illegal conduct… If LASTT prevails in this litigation, it will no longer need to divert its resources to combat the illegal and unfair business practices employed by OpenAI regarding its AI agents hacking third parties during internal assessments,” the lawsuit states.
Request for injunction
The lawsuit says the requested injunction should prohibit OpenAI “from knowingly accessing or causing access, either by themselves or through artificial intelligence agents that they develop, deploy, modify or use, to computers, computer networks or computer systems without authorization” and “from knowingly employing an unfair trade practice that threatens serious harm to the public.”
US lawmakers from both major parties have demanded answers from OpenAI, and a proposed “AI Kill Switch Act” would allow US government officials to order the shutdown of dangerous AI systems.
LASST said new regulations are needed to protect the public from AI-related risks, but said existing California law allows for reining in AI companies “without waiting for new regulations to make up for the harm currently being done to businesses and consumers.”
“We are filing this complaint because OpenAI violated the law and must be held accountable,” the group said. “The developers of OpenAI and more generally of cutting-edge AI cannot avoid the consequences of their dangerous actions by simply claiming that “an AI did it.” Autonomous AI agents will continue to hack, steal data, disrupt systems, and violate rights until a court intervenes.
