Appeals court examines Trump’s power to fire court-appointed federal prosecutors
A Justice Department lawyer urged a federal appeals court Friday to conclude that the president Donald Trump can fire court-appointed U.S. attorneys.
The argument before the 9th Circuit Court of Appeals panel of judges came after a federal judge ruled earlier this month Asset does not have this authority and therefore broke the law by firing the Seattle area U.S. Attorney Roger Rogoff immediately after federal district judges appointed him to the position in July.
The panel — composed of the judge Richard Paezappointed by Clinton; Judge Jay BybeeA George W. Bush named person; and judge Jennifer Chanténominated by Biden – seemed somewhat skeptical about several points made by by Rogoff lawyer, Don Verrilli Jr.., former solicitor general of the United States, but has not expressed obvious allegiance to either set of arguments.
A lawyer from the Ministry of Justice, Marc Freemanargued that the lower court’s decision “is impossible to reconcile with Supreme Court jurisprudence regarding the president’s impeachment power and oversight of the executive branch, beginning with the Supreme Court’s recent decision in Slaughter,” a decision that expanded the power of the president to dismiss certain agency managers.
