Attempted murder, aggravated assault charges filed in fatal shooting of sheriff’s deputy
SIOUX FALLS, SD (Dakota News Now) – The suspect charged in the fatal shooting of Sheriff’s Deputy Katherine Frank faces three counts of attempted first-degree murder and three counts of aggravated assault of a law enforcement officer.
Court documents filed Oct. 10 indicate officers were called to the home of Brandon John Oetken, 39, on Friday, Oct. 9, to serve a mental illness hold. Three police officers, including Frank, intervened. A witness told investigators that Oetken recognized them as police officers.
The documents say Oetken retreated into the house while speaking with officers. They followed to maintain contact. As the officers stood close together in the entryway, Oetken allegedly pulled out a handgun and pointed it at them.
As the officers retreated, Oetken allegedly fired, hitting Frank at point-blank range. Another officer returned fire, hitting Oetken several times.
According to court documents, DCI agents reviewed police body camera footage.
