A close ally of the president on Capitol Hill Donald Trump sues Justice Department and former special counsel Jack Smith for obtaining his telephone records as part of his investigation into Trump’s attempt to overturn the 2020 elections.
The senator Marsha Blackburn (R-Tenn.) filed suit a day later Black-smith testified before the Senate Judiciary Committee – on which Blackburn sits – and defended his office’s investigation, including its efforts to obtain records of Black burn and dozens of other GOP lawmakers who spoke with Asset and his advisors for a period of four days in January 2021.
Black burn argues that Smith committed a “gross abuse of power” and violated constitutional protections for members of Congress when he subpoenaed his phone logs from Verizon and obtained a court order to prevent the company from alerting him. She is asking a federal judge to declare Smith’s entire investigation, as well as his efforts to obtain his phone records, illegal. She also asks that the judge order Black-smith and the Department of Justice destroys or returns all its documents.
Black-smith claimed to have searched phone logs – which do not include the contents of calls or text messages – as part of its investigation into Trump’s attempt to overturn the election results, even as a mob of his supporters ransacked the Capitol on January 6, 2021. Asset and his aides continued to call that night and encourage lawmakers to derail the transfer of power to Joe Biden.
