Halle Berry accused of choking her 12-year-old son as her ex pleads for sole custody under restraining order

Halle Berry’s ex-husband, Olivier Martinez, has filed a temporary restraining order against the actress, accusing her of physically abusing their son, Maceo.

On Sept. 26, Berry allegedly jumped on their 12-year-old son, put his hands around his neck and choked him, Martinez alleged in new court documents obtained Thursday by Page Six.

Berry’s fiancé, Van Hunt, was allegedly present during the incident, according to Martinez, who claimed the argument started after Berry told Maceo he looked “stupid” and that he was “so stupid” for playing a game with his virtual reality glasses on.

“The situation escalated and petitioner jumped on our son and began to physically fight with him,” Martinez alleged in the documents. “She grabbed Maceo by the neck and started choking him, screaming: ‘Who’s dominant now?! Who’s dominant?!'”

Martinez claimed a panicked Maceo called to pick him up after the alleged incident – ​​and said he didn’t want to go back to his mother because he was “traumatised”.

Additionally, Martinez alleged in the documents that Berry had been violent toward their son on multiple occasions and that this was not an isolated incident.

“Over the past year and a half, Ms. Berry had pinned Maceo to the ground and forced him to ‘tap,'” he alleged in the documents.

Martinez also alleged in the filing that Berry caused Maceo mental and emotional distress due to racist statements. He claimed that in 2023, the Oscar winner allegedly told his son that his father was “a fucking white guy trying to steal from a black woman” due to child support issues.

“Ms. Berry then asked our son, ‘What do you think about this as a black man?'” he says.

Martinez states in the documents that he has “significant concerns” about Berry’s mental health, “as well as his alcohol abuse, which I believe contributed to his abusive conduct.”

Martinez is seeking sole custody of Maceo, in addition to restraining orders for him and his son.

Page Six reached out to representatives for Berry and Martinez, but did not receive an immediate response.

Berry and Martinez, both 60, were married for two years before separating in October 2015. Their contentious divorce took eight years to finalize.

In September 2024, she claimed in a court filing that she spent more than $200,000 trying to co-parent Maceo amid their bitter custody battle.

“I have made every effort to work with Olivier, communicate with him and involve him in the decision-making process regarding our son amicably,” she wrote in court documents.

Berry argued that her ex had “refused to co-parent and communicate with me in a child-centered way” and had instead “been oppositional and steadfast on all major issues related to Maceo.”

Berry is also the mother of a daughter Nahla, 18, whom she shares with her ex Gabriel Aubry.
