Halle Berry claims son, 13, leaves ex Olivier Martinez’s house ‘angry and combative’ in new court documents as battle intensifies
Halle Berry has hit back at her ex-husband Olivier Martinez in new court documents, accusing him of influencing their son Maceo to be “angry and combative” towards her.
The actress asked the court to reinstate her 50/50 custody agreement for Maceo, 13, in court documents obtained by People Monday.
The filing comes after Martinez obtained primary custody of Maceo as well as a temporary restraining order against him, alleging that she choked Maceo during an argument and was abusive toward him.
Berry alleges in the new documents that Martinez provokes Maceo’s anger toward her because of her “continued attempts to align Maceo with him and against me in many areas of our child’s life and activities.”
“When Maceo returned from his shift with Olivier, he was angry and combative,” she claims in the documents.
“I also perceived Maceo as repeating the disagreements that Olivier and I were discussing privately and taking Olivier’s side/position in this dispute,” she also claims.
According to the documents, Martinez’s behavior led their son to completely disregard Berry’s authority as a mother, and she claims Maceo was personally negatively affected.
“(Martinez’s) refusal to allow early intervention caused Maceo to fall further behind in school, worsened Maceo’s acting out behaviors, and caused additional damage to the relationship between Maceo and (Berry),” she alleges in the documents.
According to the new filing, Martinez refused to accept Berry’s relationship with her fiancé, musician Van Hunt. Berry claims that Martinez does not allow Maceo to attend family therapy with her and Hunt, in an effort to create a healthy blended family.
The Oscar winner is also asking the court to force Martinez to attend court-ordered therapy sessions.
The French actor filed a response and asked the court to reject Berry’s request, People reported.
Berry and Hunt were spotted spending time with Maceo Sunday in photos obtained by Page Six. The trio attended Sky Zone in Los Angeles in photos obtained by Page Six and were accompanied by some of the teen’s friends.
The outing comes after Martinez alleged in her court filing that on Sept. 26, the “Monster’s Ball” actress jumped on Maceo, put her hands around his neck and choked him after the two argued over his playing a virtual reality game.
Additionally, Martinez alleged that Berry had been violent toward their son on multiple occasions and that this was not an isolated incident: “Over the past year and a half, Ms. Berry had pinned Maceo to the ground and forced him to ‘stand down.’
The “SWAT” star included private text messages in the filing, in which Maceo begged his father to choose him after his mother allegedly choked him.
Berry denied Martinez’s shocking allegations against her through her attorney, who called her filing “totally baseless and deliberately misleading.”
“There is ample evidence, including numerous court rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son, Maceo – a misconduct for which Mr. Martinez has already been legally sanctioned,” the actress’s attorney, Marina Beck, shared in a statement to Page Six.
Berry and Martinez, both 60, first met on the set of their film “Dark Tide” in July 2010. They married in July 2013 and were married for two years, before separating in October 2015.
Their extremely contentious divorce took eight years to finalize.
