Halle Berry learns her fate in bitter custody battle with ex Olivier Martinez after explosive abuse allegations
Halle Berry has won a major victory in her bitter custody battle with ex-husband Olivier Martinez.
Los Angeles Superior Court Judge Shelley Kaufman on Thursday denied Martinez’s request for a domestic violence restraining order protecting him and their 13-year-old son, Maceo, and lifted temporary restrictions on the actress.
The ruling is a big victory for Berry, who accused Martinez of escalating their custody dispute by alleging she abused their teenage daughter.
“We are extremely pleased that the Court has dissolved the TRO,” Berry’s attorney, Marina Beck, told Page Six exclusively. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family. »
A source added: “This is a huge win for Halle. »
Martinez’s attorney did not immediately respond to our request for comment.
Page Six can also confirm that the former couple’s custody agreement resulting from the previously granted temporary restraining order will remain in effect until the matter is addressed at a later hearing.
Martinez will retain primary physical custody, while he and Berry will continue to share legal custody.
Kaufman’s decision followed nearly four hours of sealed testimony from Maceo on Oct. 19, the first day of the hearing, when his therapist and a school official also took the stand.
Berry and Martinez also testified, the latter storming out of the courtroom and using profanities as he appeared agitated and upset by the closed-door discussions.
Berry’s daughter, Nahla Aubry, 18, and her fiancé, Van Hunt, also testified in a closed courtroom during the nine-day proceedings.
Aubry previously defended her mother in a statement to the court, saying she was “shocked” by the abuse accusations and had never seen her behave aggressively towards her half-brother.
Martinez, 60, accused Berry, also 60, of physically abusing Maceo — including choking him during a Sept. 26 altercation — as part of a request for a domestic violence restraining order. He also requested sole legal and physical custody.
Kaufman granted Martinez’s request for a temporary protection order on October 1.
Berry, meanwhile, has consistently denied the allegations detailed in the filing.
“There is ample evidence, including numerous court decisions, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son, Maceo – misconduct for which Mr. Martinez has already been legally sanctioned,” his attorney, Marina Beck, previously told Page Six.
The “Monster’s Ball” star had asked the judge to deny Martinez’s request for a restraining order and lift the temporary restrictions.
She accused the French actor of escalating their custody dispute and interfering with their son’s educational and therapeutic needs.
Berry requested sole legal custody of Maceo, which would give him greater authority over decisions regarding his health, education and well-being, while proposing that the former couple continue to live on alternating weekdays.
Additionally, it asked to expand its existing tie-breaking power to cover decisions regarding the adolescent’s health, education and well-being.
The Oscar winner and Martinez were married from July 2013 until they separated two years later. They were declared legally single in December 2016 before finalizing their divorce in August 2023.
