Hershey changed its label on Reese’s Peanut Butter Pumpkins to clarify this point after a lawsuit, reports The United States today. “No carving on actual product,” the label now reads, a step up from the previous “Decoration Suggestion.” The move follows a lawsuit in Florida accusing Hershey of deceptive advertising, according to NBC News. One person involved in the lawsuit said they “believed the product contained a cute carving of the mouth and eyes of a pumpkin,” according to court documents. Alas, the chocolates were virgins.
A federal judge threw out the case in September, ruling that the only harm was the plaintiffs’ “subjective disappointment” and noting that they still had edible Reese’s. The plaintiffs, who sought $5 million, can appeal. Hershey did not say whether its new wording was related to the lawsuit.
