Lindsay Clancy to attend hearing Monday as decision on retrial nears
PLYMOUTH, Mass. —
Lindsay Clancy, the Massachusetts mother accused of murdering her three children in 2023, returned to court Monday for a motion hearing while she waits for the district attorney to decide whether to pursue a second trial.
While in court Monday morning, defense attorney Kevin Reddington told reporters, “It’s a great day to continue the journey.”
Clancy, 36, went on trial this summer for the deaths of Cora, 5, Dawson, 3, and Callan, 8 months, at their Duxbury home on Jan. 24, 2023. Her defense argued she was not criminally responsible for the killing because she was suffering from postpartum psychosis at the time of the killings.
The jury ultimately deadlocked, with an 11-1 split in favor of acquittal after seven days of deliberations. A mistrial was declared.
In a recent motion, the prosecution argued that the trial ended in a legally justified mistrial. They also argue, citing the Karen Read case, that the Supreme Judicial Court has already ruled against allowing “jurors’ post-trial disclosures about their deliberations to affect the analysis.”
Earlier this month, the judge also denied Clancy’s request for an evidentiary hearing regarding the holdout juror who caused the mistrial. This decision also cited the precedent set in the Read case.
At the same time, the defense is also asking the judge to reject proposed restrictions on what can be said publicly about the case. They argue that the Commonwealth has not shown enough reason to justify limiting what can be said after a mistrial.
Prosecutor Tim Cruz’s office has not announced whether it will pursue a second prosecution. Cruz, a Republican, is running unopposed for reelection in November.
