The explosive testimony of Caleb Flynn’s former mistress may have given Ohio prosecutors a crucial piece of their murder case against the former “American Idol” contestant – a potential answer to why he allegedly killed his wife, a former prosecutor told Fox News Digital.
“Motive. She provides motive,” Josh Ritter, a former prosecutor, criminal defense attorney and Fox News contributor, said of Alleigha Botner’s testimony. “It gives jurors a reason why this man would murder his wife.”
“It sounds like she was, by all accounts, a very nice woman,” Ritter said of Ashley Flynn. “She’s the mother of his children. Yes, he wanted to separate.”
“Maybe there was a financial gain to the idea of life insurance, but you know, jurors often have a hard time answering that question,” he added.

Flynn is accused of fatally shooting his wife in the back of the head in their Ohio home on Feb. 16 and arranging the scene to make it appear as if an intruder had broken in. He has pleaded not guilty to aggravated murder and other charges.
Botner, who said she had an affair with Flynn for about a year and a half, spent two days explaining to jurors many of the more than 107,000 messages exchanged during their relationship.

Some contained explicit discussions of Ashley’s death.
In a May 2025 post, Flynn reportedly wrote, “If I could literally kill her and not go to hell, I would in a heartbeat.” »

A few days later, he reportedly wrote: “I hate her, I hate her. I want him dead. »
In June, Flynn allegedly told Botner, “Please hire someone to take him out. I need you in my life, I need you.”

Botner replied: “So tempting. I can’t live without you. And I’ve had this thought so often lately. How can we understand this?”
Botner also became emotional when reading one of her own messages to Flynn, expressing regret that she had never written it.

“I want to kill her, Caleb,” she wrote.
“That makes two of us,” Flynn allegedly responded.

Ritter said it’s the substance of those exchanges — rather than the mere existence of the case or the sheer volume of messages — that could prove important to prosecutors.
“It’s the idea that he even talks about his death,” Ritter said. “He went so far as to say I would literally kill her. It’s so much more than someone expressing their frustrations and expressing to a lover that I wish my wife wasn’t here, I wish she would leave, I wish we could divorce.”
“It’s saying that you want this person dead, and that, in your opinion, is your solution to the problem that you have,” he added.

The messages became particularly meaningful as prosecutors brought jurors closer to the night Ashley was killed.

Botner testified that Flynn told her in an August message that he stayed up until 4 a.m. “literally thinking of ways to kill her and not go to jail.”
A few months later, Botner gave Flynn an ultimatum on January 11 to leave Ashley or she would end their relationship. Unable to do so, Botner cut off communication until February 14, just two days before Ashley’s death.
On the night of February 15, the two communicated again.
Botner testified that Flynn discussed his plans for the next day, including telling his family members about the divorce and getting a cell phone.

Shortly after midnight, Flynn reportedly wrote to Botner: “This is happening.”
He then wrote: “February 16th – day I will never forget.”
“You’re about to be free,” Botner replied.
“I choose you,” Flynn replied.
Those were some of the last messages Flynn sent Botner before learning Ashley had been killed, she testified.
Ritter pointed out that this moment was one of the most important pieces of evidence Botner brought to the prosecution.
He noted that Flynn had spent months talking about wanting Ashley dead before the messages reached the day before her murder.
“The day before the murder, he told his mistress that tomorrow would be a great day, that he would choose her,” Ritter said. “He has made a decision and that tomorrow, which is February 16, the date his wife was murdered, will be a day he will never forget.”

But Ritter said the same enormous volume of messages that prosecutors are using against Flynn also gives his lawyers an argument.
The defense can argue that prosecutors cherry-picked the most damaging statements from more than 100,000 messages exchanged during an intense case and stripped them from the broader context of two people using exaggerated and sometimes ugly language.
Flynn’s lawyers can also argue that when he talked about what would happen on Feb. 16, he was referring to his permanent departure from Ashley — not her death.

“That could be true,” Ritter said. “He might just be the unluckiest man in the world, that the day he tells his mistress he’s going to tell his wife he’s leaving her after months of saying he wanted her dead, a random burglar breaks in with no signs of forced entry, walks to his vehicle, knows exactly where to find his handgun, goes upstairs, puts two bullets in the back of his wife’s head while she sleeps and leaves the rest of the house alone.
During cross-examination Thursday, Flynn’s attorneys began introducing the jury to Botner’s language.

“I’m so done with you. You murdered my heart,” Botner admitted, writing to Flynn during an argument. “I hope you are happy that you took my virginity and also my heart and trampled it everywhere. Enjoy your marriage. I’m done.”
The defense also has another potentially important distinction to point out, Ritter said. Despite Flynn’s repeated statements that he wanted Ashley dead, he never explicitly told Botner that he intended to carry out her murder.
“There was never any explicit mention of, ‘I’m going to do this, I’m going to follow through on it,'” Ritter said.

“I think they’re also going to focus on the idea, as they have since their opening statements, that maybe this was a rush to judgment, that once the police found out about it, they stopped their investigation,” Ritter said. “And once they knew he was considering leaving his wife, they thought, ‘Well, that’s enough for us. We’re not going to pursue any other avenues.'”

“I’m not saying it’s a compelling argument, but I’m saying it’s at least something they can rely on and mount a defense on his behalf,” he added.

The defense can also point to the absence of the alleged murder weapon, an eyewitness to the shooting and gunshot residue on Flynn.

Botner testified, however, that Flynn once showed her a gun he kept inside the center console of his truck, although she didn’t remember what it looked like.

“In an ideal world, would the prosecution want the murder weapon? Of course,” Ritter said. “But… it’s something the defense is obviously going to lean on.”

But for Ritter, Botner’s testimony ultimately comes back to the question prosecutors hope jurors will ask when considering the killing: Why?
