
Halle Berry’s ex, who got a temporary restraining order, claims she abused their son

Halle Berry’s lawyer fired back Thursday, calling her ex’s claims that she abused their son “baseless.”
Olivier Martinez obtained a temporary restraining order from the actress on Thursday, according to TMZ.
Martinez is also seeking sole custody of their 12-year-old son, alleging she physically and emotionally abused the boy, according to documents obtained by People magazine and TMZ.
Martinez claims Berry caused her “emotional and mental distress due to the physical abuse of our minor child, Maceo,” adding that she “physically abused our son, Maceo, by jumping on him, putting her hands around his neck and choking him,” according to People.

“Although the September 26, 2026 incident in which the petitioner suffocated our son was the latest incident of abuse, I submit that there have been other instances of abuse in recent years.
“These other incidents involve additional physical attacks on our son, as well as verbal and emotional abuse by the petitioner towards me.”

In response, Berry’s attorney, Marina Beck, told Fox News Digital: “To say that this filing is completely baseless and deliberately misleading would be an understatement. There is ample evidence, including numerous court decisions, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son, Maceo – a misconduct for which Mr. Martinez has already been legally sanctioned.
“In some ways, today’s filing is not entirely unexpected from someone with a well-documented history of erratic, possessive and violent behavior. Fortunately, Halle is accustomed to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow this to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
Berry is required to stay 100 yards away from Martinez under the terms of the restraining order, and she can only see Maceo during court-ordered visits two days a week and every other weekend until a hearing on Oct. 16, TMZ reported.
The former couple was also ordered to attend confidential custody mediation.
Martinez claimed Berry angrily walked into their son’s room, saw him wearing virtual reality glasses while playing a game and told him he looked “so stupid.”
He said she then jumped on him, attacked him, strangled him and screamed: “Who’s dominant now?!”
Martinez claims Maceo called him after the incident and claimed she attacked him. He also said Berry’s fiancé, Van Hunt, was home at the time.
The petition also calls on Berry to not be under the influence and to submit to sobriety tests before, during and after any visits with their son.
Representatives for Martinez did not immediately respond to Fox News Digital’s request for comment.
The former couple finalized their divorce in 2023, eight years after their separation.
As part of the settlement, the actress agreed to pay nearly $8,000 in monthly child support for their son, according to court documents obtained by Fox News Digital. She also pays Martinez 4.3% on any income she earns that exceeds $2 million.

Berry is responsible for their son’s private school tuition, 100 percent of his extracurricular activities and his health care.

According to the divorce decree, Martinez is required to take “reasonable steps” to find employment and contribute to Maceo.

The couple first filed for divorce in 2015, after two years of marriage.

Under the current agreement, Maceo splits his time between both parents during the week and alternates weekends with exceptions for certain holidays. He is allowed to have a phone or video call with the other parent before bed, but it must last less than 15 minutes, according to the 33-page ruling.

Berry and Martinez must also refrain from speaking ill of each other in front of Maceo.

The request for a restraining order comes two years after Berry requested sole custody of Maceo due to Martinez’s “turbulent and detrimental behavior” toward interventions for their son’s educational and therapeutic needs that allegedly impacted Maceo’s relationship with Berry.
