The New York Times has obtained more than 1,000 pages of internal documents from the Cornell University investigation into an alleged gang rape at a fraternity in 2024. The contents of the New York Times report were corroborated to CNN by Jane Doe’s lawyer, who added “we are not responsible for the leak of these documents.” Debra Kamin, the investigative journalist who broke the story, tells Erin Burnett, “when she saw someone else describe what had happened to her as gang rape…and (had) to wonder what that could mean and what she would have to do with that knowledge.”

A heavily redacted 99-page document obtained by CNN, which summarizes key evidence included in a Cornell University disciplinary committee’s decision, echoes some New York Times reporting on the men’s accounts, including that at least one of them said he could not say the victim was under the influence.

The committee’s decision indicates that more than 50 interviews were conducted as part of the university investigation, including all of the men accused of participating in it, except for one who refused to be interviewed.

Although CNN was unable to view the entire document due to redactions, the document describes alleged heavy drug and alcohol use that night in the fraternity house and details interactions between the men and Jane Doe, some of which took place after a message saying “free pussy” was posted on a Snapchat group text.

One of the men said he and another went into the room after seeing that message to see if everything was okay, telling investigators “I was a little confused” after reading the text. He said he spoke with Jane Doe and asked one of the men and Jane Doe if they were “fine,” to which both responded affirmatively.

One of the accused men, whose name was redacted, told the panel, according to the document: “I was sorry that maybe if it wasn’t consensual and she was a victim, I was sorry that I didn’t stop it. And that I’m sorry that I couldn’t say if she was under the influence … just sorry that I felt like if something really bad happened, I didn’t stop it.”

According to the document, at least one of the men violated the school’s policy against sexual exploitation and sexual assault, and at least one respondent was found responsible for attempted sexual exploitation, but was not found responsible for sexual assault.

For the man found responsible solely for attempted sexual exploitation, the Cornell panel imposed several sanctions, including a “no contact order” with Jane Doe and an order to submit to the Title IX office a “reflection paper” on the circumstances under which he was found responsible.
