NEW YORK — Mayor Zohran Mamdani The administration must redo the deployment of the pied-à-terre tax, a Staten Island judge ruled Tuesday.
Judge Wayne Ozzi’s ruling sides with New York homeowners who challenge At Mamdani’s rollout of the surcharge, which applies to second homes in the city worth more than $5 million. The complaint, filed last month, alleges the administration failed to do sufficient due diligence before sending letters to some 17,000 homeowners and separately challenged a public list of some 900,000 homes that could be subject to the tax.
According to Ozzi’s order, the city must send new notices “consistent with the intent of the law.” The notices published so far are essentially canceled. The decision also eliminates the city’s exemption process, which Ozzi is considered an “unlawful transfer of burden”.
