
Massachusetts judge rejects Lindsay Clancy’s not guilty plea
Lindsay Clancy’s defense says there is ‘no evidence’ she killed her children
Legal clashes erupt in Plymouth, Massachusetts, as defense attorney Kevin Reddington says there is no proof Lindsay Clancy killed her three children. Assistant District Attorney Shanan Buckingham counters that the evidence is voluminous. Attorney Edward Paltzik also criticizes the defense’s actions following the mistrial as both sides prepare for a crucial hearing in November.

Massachusetts Judge William Sullivan denied Lindsay Clancy’s motion for a not guilty verdict.
Sullivan had denied a similar motion when his mistrial was declared Sept. 4, and denied another attempt Thursday after defense attorney Kevin Reddington argued earlier this week that Plymouth County prosecutors did not present enough evidence at trial to prove his client’s guilt beyond a reasonable doubt.
“Evidence has been presented, both material and circumstantial, that would enable a rational finder of facts to find beyond a reasonable doubt the elements of the murder charge,” Sullivan wrote.

He also disagreed with Reddington’s argument that the state failed to prove that Clancy could have been criminally responsible for the murders.

“Mental illness alone does not preclude a finding of criminal liability beyond a reasonable doubt,” Sullivan wrote.

“The Commonwealth’s theory of criminal liability was that when the defendant committed the crime, she did not lack substantial capacity to appreciate the criminality or wrongfulness of her conduct and did not lack substantial capacity to conform her conduct to the requirements of the law,” he continued. “To support this position, the Commonwealth presented evidence regarding the nature and methods of the murders as well as the actions and behavior of the defendant at certain times surrounding the murders.”
